A complete list of statutes that provides an understanding of the requirements to make disclosures regarding the transfer of real property can be found in Chapter 64.06 RCW-REAL PROPERTY TRANSFERS—SELLERS' DISCLOSURES

As a home seller in Washington, pursuant to RCW 64.06.020, you might need to disclose the knowledge you have of the condition of your home. Exceptions to the disclosure can be found in RCW 64.06.010

The sale of commercial property requires compliance with the disclosure of property per RCW 64.06.013

Unimproved Residential property disclosure is governed by 64.06.015

Condominium sales will also involve a Resale Certificate that is provided by the Condominium Association or it’s representative. You are require to provide the resale certificate to the buyer for their review.

AThe seller’s disclosure if required, must be given to the buyer not later than 5 business days after the purchase and sale agreement is fully signed by both buyer and seller.

After the buyer receives the fully completed and signed disclosure, the buyer has the right to cancel the purchase and sale agreement within 3 business days. No reason is required.

Because of this, it is often in the seller’s best interest to give the disclosure statement to the buyer even before the parties sign a purchase and sale agreement.

The seller should get a receipt, that includes the buyer’s signature and date acknowledging the buyer’s receipt of the seller disclosure form.

If the buyer doesn’t take action within 3 business days of receipt of the seller disclosure statement, the buyer is deemed to have approved and accepted the seller disclosure statement.
